Is It Illegal to Leave Your Pet Chained Outside in Texas Here's What the Law Says
As of February 2025, it is indeed illegal to leave your pet chained outside in Texas. This law, known as the Safe Outdoor Dogs Act, went into effect on January 18, 2022, and has since been enforced throughout the state.

Key Points of the Texas Dog Tethering Law

Prohibited Restraints
  • Chains and heavy weights are banned as restraints for dogs left outside.
  • The use of any restraint that has weights attached is illegal.
Acceptable Restraints
  • If a dog must be tethered, the restraint must be at least five times the length of the dog (from nose to tail base) or 10 feet, whichever is greater.
  • The dog’s collar or harness must be properly fitted and designed specifically for dogs.
Shelter Requirements
  • Dogs left outside must have access to adequate shelter that protects them from inclement weather.
  • The shelter must be large enough for the dog to stand, sit, turn around, and lie down comfortably.
Additional Provisions
  • Dogs must have access to shade from direct sunlight.
  • Clean, potable drinking water must be available.
  • The area must allow the dog to avoid standing water and excessive animal waste.

Enforcement and Penalties

  • Violations of this law are considered a Class C misdemeanor, punishable by a fine of up to $500.
  • Repeat offenders may face a Class B misdemeanor, which can result in up to 180 days in jail or a fine of up to $2,000.
  • The law eliminated the previous 24-hour waiting period, allowing law enforcement to intervene immediately if they observe a dog in illegal or inhumane conditions.

Exceptions

The law does provide some exceptions, such as:
  • Temporary restraints used while camping or in recreational areas.
  • Using a handheld leash to walk a dog.
This law represents a significant step in animal welfare for Texas, aligning the state with many others that have implemented similar regulations to protect dogs from inhumane tethering practices. It’s important for all dog owners in Texas to be aware of these regulations and ensure they are providing proper care and restraint for their pets when outdoors.Sources
