Kay Flock was found guilty in a federal RICO case and faces life in prison

Kay Flock, born Kevin Perez, a Bronx drill rapper, was found guilty of multiple charges in his federal RICO trial, according to the Inner City Press.

On Thursday (March 20), a New York jury convicted Kay Flock of racketeering conspiracy, use of a firearm resulting in death, attempted murder, assault with a dangerous weapon in aid of racketeering, and attempted murder with a firearm. However, he was found not guilty of murder in aid of racketeering for the 2021 shooting of Oscar Hernandez outside a Harlem barbershop.

Flock, who was arrested in December 2021, now faces a possible life sentence, with his sentencing set for July 16.

The trial, which began on March 10, featured testimony from a number of witnesses, including cooperating witness Vance Brockington, who claimed that Flock retaliated for him after he was shot by a rival gang.

Brockington claimed that Flock FaceTimed him from the hospital before carrying out the shooting. Prosecutors also relied heavily on the rapper’s lyrics and music videos, claiming they were evidence of actual gang activity.

The defense countered, claiming Flock was targeted for his music rather than any actual crimes. His lawyer framed the case as an attack on drill music, saying in closing arguments, “This is U.S. versus drill rap.”

Flock was originally charged with Hernandez’s murder in 2021, with his legal team claiming self-defense. Surveillance footage allegedly shows Hernandez approaching Flock prior to the fatal shooting. Federal prosecutors escalated the case in February 2023, linking him to the Sev Side/DOA gang and charging him with multiple Bronx shootings between 2020 and 2022.
