From the Shiawassee County Sheriff’s Office

Sheriff Brian BeGole issued a statement this morning, Friday, Sept. 29 regarding an arrest made by the Shiawassee County Sheriff’s Office. The statement goes as follows:

Mindy Portner was arrested yesterday by the Shiawassee County Sheriff’s Office. Portner is charged with bringing contraband into a correctional facility and delivery of a controlled substance. Portner is being held on a $10,000 cash surety bond. A lengthy police investigation has shown that Portner filled a prescription the day before her sentencing. It is believed that Portner smuggled prescription pills into the jail, which were concealed in her vagina.

While in a jail cell, Portner was seen removing a duct taped item from her vagina that is believed to have contained the prescription pills.

Portner shared these pills with April Hart, who then gave it to Sarah Yerian. Ms. Yerian ingested these pills which caused her death.

A review of Mindy Portner’s booking process found that Sheriff’s Office employees followed all jail policies and procedures, which included a strip search prior to Portner being placed into jail population.

Cavity searches cannot be conducted unless a search warrant is obtained. To obtain a search warrant, one has to have probable cause, which in this case, probable cause did not exist.
